Unanswered complaints management: what to do with overdue PQRS

Unanswered complaints management starts by separating legal risk, operational urgency, and response quality. If you have overdue PQRS in Colombia, don’t answer in bulk without checking the rules, notice, and merits of each case.

Key takeaways

  • Classify by legal regime first. An overdue PQRS may fall under general petition rights, consumer rules, telecom, residential public utilities, or personal data rules.
  • Not every reply works. Colombia’s Constitutional Court has said a response must be clear, precise, consistent, substantive, and communicated effectively.
  • The general baseline is 15 days. Unless a special rule applies, Law 1755 of 2015 says petitions must be resolved within fifteen days after receipt.
  • AI helps classify and summarize. It shouldn’t decide legal effects or send responses without human review when PQRS are overdue.

What risk does unanswered complaints management create in Colombia?

In Colombia, an overdue complaint isn’t only a late task. It can trigger legal deadlines, complaints before regulators, tutela actions, or user-favorable effects.

The general baseline is Colombia’s Law 1755 of 2015. This law regulates the right of petition and allows people to file inquiries, complaints, reports, claims, and appeals. Unless a special rule applies, a petition must be resolved within fifteen (15) days after receipt; document and information requests, within ten (10) days; and inquiries to authorities, within thirty (30) days.

The same law also applies to petitions before private organizations when they seek to protect fundamental rights. Some private entities with users, such as public utility companies, financial institutions, social security entities, and family compensation funds, have similar rules where applicable.

A late response doesn’t always mean losing the case, but it does increase risk. In decision T-174 of 2026, Colombia’s Constitutional Court restated that the right of petition requires a substantive, clear, precise, consistent, and effectively communicated response. It also said that automatic and incomplete responses did not satisfy the right of petition in the case under review.

This article is an operational guide for companies in Colombia. It isn’t legal advice. If sanctions, positive administrative silence, or litigation are involved, legal should review the case.

How do you prioritize overdue PQRS by legal regime?

Before responding, separate PQRS by legal regime. The deadline and effect of missing it change by case type.

Case typeWhat to review firstMain riskFirst action
General right of petitionFiling date and channelTutela action or disciplinary complaintSubstantive response and proof of delivery
TelecomPQR, appeal, and evidencePositive administrative silenceValidate deadline and user-favorable effect
Residential public utilitiesBill, claim, and noticePositive administrative silenceCheck whether there was a substantive response
Personal dataPrior claim and responseEscalation before the SICVerify identity and request
Consumer and warrantyProduct, date, and requested remedyClaim before the SICRespond on repair, replacement, or refund

In telecom, Colombia’s CRC says the provider has 15 business days from the day after filing to respond to a PQR, with a possible extension when evidence or information is required. In telecom, positive administrative silence may apply if the provider doesn’t respond within the applicable deadline. In residential public utilities, Superservicios says the company must respond within fifteen (15) business days; after the deadline, except for specific exceptions, positive administrative silence may apply. Superservicios says it may also arise from a lack of substantive response or improper notice. For SIC Facilita claims, the 2025 consumer manual asks for prior claim information in personal data cases and specific product, date, price, problem, and remedy details in warranty claims.

What should you do first with overdue PQRS?

The first goal isn’t to close everything. It’s to regain control and avoid responses that create more risk.

  1. Freeze mass responses. Pause automatic closure emails, generic templates, and responses without a case file. A late and weak response can be worse than a late response with support.
  2. Build one inventory. Cross-check email, CRM, WhatsApp, web forms, and physical filings. Each case needs a number, receipt date, channel, user, subject, status, owner, and available evidence.
  3. Classify by regime and deadline. Mark overdue cases with possible positive administrative silence, overdue cases without that effect, cases near deadline, incomplete cases, bad notices, and duplicates. This matrix sets the work order.
  4. Assign an owner and approver. Support can prepare the file. Operations provides the facts. Legal reviews risk. One final owner approves the response when deadlines have expired.
  5. Answer the highest-impact cases first. Prioritize users with active harm, disputed charges, service suspension, personal data, health, safety, or cases already escalated to an authority.
  6. Measure quality before sending. Check whether the response answers the request, cites case facts, explains the decision, and leaves proof of notice. This applies even if you use AI automation to prepare drafts.

What does an operational rescue for overdue PQRS look like?

This example is illustrative. It doesn’t refer to a client.

Input

PQRS inbox with overdue cases

A company receives complaints by email, web form, and WhatsApp. There are billing claims, certificate requests, and service complaints. Some messages have filing numbers and others don’t.

The first deliverable is a clean database, not a chatbot.

System

Classification, summary, and controlled draft

The system reads each file and identifies the likely regime, due date, request, missing documents, and responsible area. It then creates a summary and a draft with required fields.

Human approval stays before sending.

Expected result

Prioritized queue and traceable responses

The team handles the highest-risk cases first. Each response keeps the file, approved version, send date, channel, and proof of notice.

Then the team measures root cause: channel, area, request type, and delay reason.

How do you stop PQRS from becoming overdue again?

Once the backlog drops, the work changes. The job is no longer firefighting. It’s controlling intake, deadlines, and quality.

  • One deadline dashboard. It should show cases near deadline, overdue cases, owner, legal regime, and blocker.
  • Templates with case data. Responses need case facts, a decision, and support. An empty template doesn’t answer the merits.
  • Quality measurement. Review a weekly sample: whether the response answers the request, whether it’s clear, and whether notice was completed.
  • Root cause by area. Separate delays caused by missing documents, missing owners, broken integrations, excess volume, or pending legal decisions.
  • Process audit. ISO 10002:2018 includes analyzing and evaluating complaints, auditing the process, and reviewing its effectiveness and efficiency in handling product and service complaints, as summarized in the official ISO 10002:2018 page.
  • Defined escalation. Personal data, public utilities, telecom, and consumer cases shouldn’t sit in the same queue without review.

What we do

Frequently asked questions

What should a company do when it has many overdue PQRS?

It should create one inventory, classify cases by legal regime, identify deadlines and risk, assign owners, and approve responses by priority. It shouldn’t answer everything with one general template. The company needs to know which cases may have legal effects, which require evidence, and which have notice problems.

Does an automatic response count as a substantive response?

Not necessarily. An automatic response can confirm receipt, but it doesn’t replace an answer that resolves the request. The response must refer to the case, explain the decision, be clear, and arrive through a valid channel. If it only says “we received your request,” it doesn’t close the duty to respond.

When does positive administrative silence apply to a PQR?

It depends on the legal regime. In telecom, it may apply if the provider doesn’t respond within the applicable deadline. In residential public utilities, Superservicios says it may also arise from a lack of substantive response or improper notice. The company should review the filing date, evidence, notice, and response quality.

What documents should a company keep to prove PQR management?

It should keep the filing number, receipt date and channel, original request, attachments, information requests, evidence, approved response, sending support, and proof of notice. It also helps to keep who reviewed and approved the response. Without that traceability, defending a response becomes harder.

Can AI answer overdue PQRS?

It can help read files, classify cases, detect expired deadlines, summarize documents, and propose drafts. It shouldn’t decide legal effects or send final responses without human approval. For overdue PQRS, the main control is process: owner, deadline, response quality, and proof of notice.
